Terms of Service

About these terms

These terms apply when you use the Driveway Visualiser website or app. Driveway Visualiser is a product operated by Madereal. The service is intended primarily for driveway, paving, landscaping and related businesses in the UK. You must be at least 18 and able to enter into a contract for yourself or the business you represent.

What the service currently does

The service can help a contractor trace an area on a property photo, request an AI-generated driveway concept, build an itemised estimate, save a project, share a customer proposal link and record proposal opens. Features, allowances and availability vary by plan and may change as the product develops. Team administration and invites are not a self-serve feature; any Team offering described on the site is a managed pilot unless we agree otherwise in writing.

Accounts and access

  • Provide accurate account and company information and keep it current.
  • Keep access to your Google account, device and proposal links secure. You are responsible for activity through your account unless caused by our failure to use reasonable care.
  • Do not share an account in a way that avoids plan limits or falsely suggests that another person or business is the account holder.
  • Free and paid rendering allowances are enforced by the service. Failed or abusive requests may be blocked or reviewed.

AI images are concepts, not specifications

AI output can be inaccurate or inconsistent. It may change geometry, drainage, borders, levels, access, colours, textures, surrounding objects or details that were not meant to change. It may not match a real aggregate, paving product or finished installation under actual lighting.

Every generated image must be reviewed before it is shown or relied on. It is a sales and discussion concept only. It does not replace a site survey, measurement, drainage assessment, planning or highways check, product sample, technical design, written specification, safety assessment or professional advice. Do not promise that a completed driveway will exactly match an AI image.

Contractor responsibility for estimates and customers

  • You are responsible for measurements, quantities, labour, materials, groundwork, drainage, timescales, price, VAT treatment and every other item in an estimate.
  • You must check company, bank, payment and finance details before sharing a proposal. Driveway Visualiser does not verify a contractor, its accreditation, insurance, bank account, finance provider or quoted work.
  • You are responsible for your own quotation terms, customer contract, cancellation rights, deposit terms, guarantees and compliance with consumer, tax, advertising, construction, planning and data protection law.
  • You must have permission or another lawful basis to upload property photos and customer information. Avoid uploading unnecessary people, number plates, neighbouring properties or sensitive information.

Proposal links, acceptance and payments

A Driveway Visualiser proposal link presents information supplied by the contractor. The service does not currently provide an electronic-signature or legal acceptance workflow, so opening or viewing a proposal does not by itself create a signed agreement. Any construction contract is between the contractor and its customer and must be formed through the contractor’s own process.

A proposal may show bank details or external payment or finance links supplied by the contractor. Driveway Visualiser does not process the customer’s construction payment, hold deposits, provide finance or become a party to the driveway contract. Customers should verify payment instructions directly with the contractor before transferring money.

Subscriptions and billing

Displayed paid plans are billed in advance through Stripe on the interval shown at checkout. By starting a paid subscription, you authorise recurring charges until cancellation. Prices and included allowances are shown before purchase; applicable taxes may be added where required.

You can manage or cancel future renewals through the billing portal where available, or contact support. Cancellation normally takes effect at the end of the paid billing period. Except where law requires otherwise, charges already incurred are not automatically refunded because the service was unused. Nothing in these terms removes rights that cannot lawfully be excluded.

Acceptable use

Do not use the service to break the law, deceive customers, impersonate another business, upload material you do not have the right to use, create harmful or discriminatory content, probe security, bypass limits, automate abusive requests, interfere with other users or distribute malware. We may restrict or suspend access where reasonably necessary to protect users, providers or the service, investigate misuse or comply with law.

Your content and our software

You keep any rights you have in photos, logos, quote content and other material you upload. You give us and our service providers a limited licence to host, copy, transmit and process that material only as needed to provide, secure and support the service. You remain responsible for having the necessary rights and permissions.

Driveway Visualiser, its interface, code, branding and site content remain ours or our licensors’. These terms allow you to use the service for your own legitimate business workflow; they do not transfer ownership or permit copying, reselling, reverse engineering or creating a competing service from protected parts of the product, except where the law does not allow that restriction.

Availability and changes

The service depends on internet access and third-party infrastructure, including AI, hosting, storage, authentication and billing providers. We aim to keep it available but do not promise uninterrupted service, a particular render time or a service-level agreement. We may fix, replace, add or remove features and may change reasonable usage limits. If a change materially reduces a paid plan during its current billing period, contact us so we can review an appropriate remedy.

No guaranteed business or visual outcome

We do not guarantee leads, sales, conversion improvements, search rankings, customer acceptance, cost savings, colour accuracy or that every AI request will produce a usable image. You decide whether the service and each output are suitable for a particular customer or project.

Liability

Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, Driveway Visualiser is not responsible for a contractor’s survey, specification, quotation, tax treatment, payment instructions, installation, customer contract or use of an AI concept as if it were a technical design.

To the extent permitted by law, we are not liable for indirect or consequential business losses, loss of profit, loss of opportunity or loss caused by information you entered incorrectly, unauthorised sharing of a proposal link, or a third-party service outside our reasonable control. Any other liability will be limited to the amount you paid for the service in the 12 months before the event giving rise to the claim. This limit does not apply where it would be unlawful.

Ending use of the service

You may stop using the service or cancel a subscription as described above. We may suspend or end access for a serious or repeated breach, non-payment, security risk, unlawful use or if the service is discontinued. Where practical, we will give reasonable notice and an opportunity to export or remove saved information, unless security or legal reasons prevent it.

Governing law and changes

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory rights that apply in another part of the UK. If part of these terms is unenforceable, the rest remains in effect.

We may update these terms as the service develops. The date at the top shows the current version. We will give appropriate notice of material changes. Continued use after the change takes effect means the updated terms apply to future use.
